All FRED jewelry and watches are designed according to very strict requirements and are subject to careful care and rigorous controls from their manufacture to their sale.
In addition to the legal warranties applicable depending on applicable law (i.e., with regard to sales subject to French law, the warranty of conformity governed by Articles L217-4 to L217-12 of the Consumer Code and the warranty against hidden defects governed by Articles 1641 to 1648 and 2232 of the Civil Code), FRED offers its customers an international commercial warranty enabling them to benefit from guarantee services in all countries.
Conditions of the FRED international warranty
This warranty benefits customers who have purchased a FRED jewel or watch from a FRED store or an authorized FRED retailer, wherever located in the world.
Documents to be submitted in order to benefit from the FRED international guarantee
To benefit from the FRED international warranty, the customer must return his jewel or watch to any FRED store or authorized FRED retailer. The customer must also accompany the delivery of his/her jewel or watch with the certificate of authenticity duly completed, dated and signed at the time of purchase (with mention of the serial number of the product, except for cables) and the purchase invoice.
Customers who have purchased their jewel or watch in a country but reside in another country must return their jewel or watch to the FRED store or authorized FRED retailer where it was purchased unless the repair can be done locally in their country of residence and the importation into the country of residence has been done in due and proper form.
Shipping costs are at the customer's expense and include shipping, insurance and packaging.
Duration of the international warranty
FRED guarantees its jewelry and watches against any lack of conformity for a period of 2 (two) years from the date of purchase.
At the end of the two-year period, any repair or replacement will be charged.
It is specified that for a quartz watch, the battery is only covered for the first year following the purchase, and the service covered by the warranty includes in this case: diagnosis of the movement, control of the movement, cleaning of the case and bracelet, replacement of the battery, control of the seals (and their replacement if necessary) and leakage control.
Beyond the first year, the replacement of the battery in a FRED store or an authorized retailer is charged to the customer.
Services covered by the international warranty
After checking the condition of the FRED jewel or watch and upon confirmation of the applicability of this warranty, FRED shall carry out the repair, or, if the repair is not possible, the replacement of the jewel or watch, free of charge within a reasonable time after the jewel or watch is returned.
Once the jewel or watch has been repaired or replaced, the customer is informed that his jewel or watch is made available to him in the shop where it was deposited.
In the event of repair:
For jewels: the repaired product will be guaranteed for one year (or for the remaining period of the two year warranty, if this period is longer);
For watches: the repair will be guaranteed for one year.
In the event of replacement of the product by a new one, the new product will benefit from the two-year FRED international guarantee.
Exclusion of the international warranty.
The international warranty does not apply in the following cases:
- normal wearing or ageing of the FRED jewel or watch (including alteration of the colour of a cable),
- abnormal use of the FRED jewel or watch (examples: impacts, crushing, falls, etc.)
- failure to comply with the instructions for use and care of the FRED jewel or watch and any negligence or failure to maintain, supervise, transport or store the FRED jewel or watch
- FRED jewel or watch that has been lost, stolen, or subjected to any other event beyond the control of FRED such as a fire,
- FRED jewel or watch that has undergone any transformation or intervention, repair or disassembly by an unauthorized third party (i.e. other than in a FRED store or by a repair shop approved by FRED),
- FRED jewel or watch whose serial number engraved on the product is illegible, altered or deleted (excluding cables).
Provisions relating to legal warranties applicable to sales subject to French law
Article 1641 of the French Civil Code
The seller is bound by the warranty for hidden defects in the item sold that make it unfit for the use for which it is intended, or that reduce this use so much that the buyer would not have acquired it, or would have given only a lower price, if he had known them.
Article 1648 paragraph 1 of the French Civil Code
The action resulting from the redhibitory defects must be brought by the purchaser within two years of the discovery of the defect.
Article L217-4 of the French Consumer Code
The seller delivers a good in conformity with the contract and is liable for any lack of conformity existing at the time of delivery.
He shall also be liable for defects in conformity resulting from packaging, assembly instructions or installation where the latter has been charged to him by the contract or has been carried out under his responsibility.
Article L217-5 of the French Consumer Code
The product is in conformity with the contract:
1° If it is suitable for the use usually expected of a similar products and, if applicable:
- if it corresponds to the description given by the seller and has the qualities that the seller has presented to the buyer in the form of a sample or model;
- if it has the qualities that a buyer can legitimately expect in view of the public statements made by the seller, the producer or his representative, in particular in advertising or labelling;
2° Or if it has the characteristics defined by mutual agreement between the parties or is suitable for any special use sought by the buyer, brought to the attention of the seller and which the latter has accepted.
Article L217-12 of the French Consumer Code
The action resulting from the lack of conformity shall be barred after two years from the date of delivery of the goods.
Article L217-16 of the French Consumer Code
Where the buyer requests from the seller, during the course of the commercial warranty granted to him when acquiring or repairing tangible personal property, a repair covered by the warranty, any period of immobilisation of at least seven days shall be added to the duration of the warranty which remained to run.
This period shall run from the date of the buyer's request for intervention or the date on which the goods in question are made available for repair, if such availability is subsequent to the request for intervention. »
